 Having in mind the resignation of Mr. Milimir Lukic, member of the High Judicial Council, Judges’ Association of Serbia issues following

S T A T E M E N T
 

The legality and legitimacy of the decisions of the High Judicial Council in the revision of the reappointments was seriously compromised by the arrest of the member of HJC, judge Blagoja Jaksic, and by failure to comply with the decision of Anticorruption Agency dated from 9th December 2010, which stated that Professor Dimitrijevic’s “public function as a member of HJC is terminated by the force of law, and remains to be discussed by the National Assembly ".

The recent resignation of Judge Milimir Lukic, member of the High Judicial Council, feeds the suspicion that the process of reviewing the decisions of the first composition of the High Judicial Council is done in an arbitrary manner and under pressure.

In situation like this, where the four members of first composition can not take part in revising the regularity of their own decision, the High Judicial Council lacks a majority of 6 votes necessary for decision making in the review process, or suitable composition in which judges make at least half the members, which is contrary to the standards and which calls into question the legitimacy of other decisions that remains to be adopted by the Council.

Judges’ Association of Serbia invites all competent authorities to enable lawful and legitimate actions of the High Judicial Council.
