Public Statement with respect to the Opinion of the High Judicial Council regarding Constitutional amendments

With respect to the Opinion of the High Judicial Council of 20 July 2018 regarding Draft Amendments to the Constitution of Republic of Serbia of 13 April 2018, and pursuing the adopted Opinion of the Venice Commission number 921-2018 of 25 June 2018 on the draft amendments to the Constitutional provisions on the judiciary, the Judges’ Association of Serbia issues the following

 P U B L I C    S T A T E M E N T

The Judges’ Association of Serbia welcomes the Opinion regarding Draft Amendments to the Constitution that the High Judicial Council published on 20 July 2018 while taking into account the strategic documents of the Republic of Serbia related to Constitutional amendments pertaining to the judiciary, as well as international standards on independence of the judiciary.

The High Judicial Council has, in this manner, acted in line with its Constitutional competence to be independent and autonomous itself in order to secure and guarantee independence and autonomy of courts and judges.

The Council’s Recommendations, which the Judges’ Association concurs with and which it has pleaded itself, secure preservation and improvement of the achieved level of independence of the judiciary and harmonization with international legal standards.

The Judges’ Association of Serbia joins the appeal of the High Judicial Council for taking into account the unanimous stance of the profession and, above all, for forming a working group which will compose the final Draft Amendments to the Constitution of the Republic of Serbia. It joins the appeal for the working group to include representatives of academia, the judiciary and professional associations, as well as to enable a genuine public discussion on the Constitutional amendments in their part pertaining to the judiciary, all in order to strengthen independence of the judiciary and the rule of law.
